Fraudulently definition in Indian Penal Code
[See: Section 25 IPC]
‘Fraudulently’.—
A person is said to do a thing fraudulently:
if he does that thing with intent to defraud
but not otherwise.
Chothmal Narayanji vs Ramchandra Govindram [1954 CriLJ 788] Court held:
‘The expression “intent to defraud” implies conduct coupled with intention to deceive and thereby to injure.’
Comments:
So ‘intention’ to defraud is the main ingredient.
Use of the words ‘but not otherwise’ denote if no intention is there a person can not be said to do a thing fraudulently
